Privacy Policy

Ohmic Labs, Inc. (“Ohmic Labs”, “Ohmic”) is committed to protecting your privacy and providing you with a secure experience through use of our products and services (“Solutions”). You can use much of Ohmic Labs’s web sites and web pages ("Sites") without giving us any information about you. We do, however, collect information to provide services and/or information that you request. This statement of privacy (Privacy Policy) explains Ohmic Labs’s data collection and use practices. This Privacy Policy applies to your use of the Sites and your use of our Solutions. Please read this Privacy Policy carefully.

Acceptance

By accessing and using any Site, Solution or other Ohmic Labs product or service, you accept and agree to this Privacy Policy.  If you do not agree to this Privacy Policy, please do not use any Site or any Solution. For other terms and conditions that govern your use of Ohmic Labs’s Solutions, Sites or other products or services, please review the other agreements to which you and Ohmic Labs are parties.

What type of information we collect from our users or visitors "Personal information" is any information that can be used to identify an individual, and may include name, username, mailing address, email address, phone number, voicemail identifiers, location identifiers, occupation, login information (username, account number, password, profile picture), language and marketing preferences, social media account information, or payment card number. 

Why we collect the information

We collect information for a variety of business and lawful purposes, such as:

  • to provision, facilitate and ease your use of the Sites and the Solutions,

  • to send Solution updates and upgrades, marketing and other communications,

to facilitate participation in our online communities, 

  • to deliver, enable and Support the use and/or testing of certain features of our Solutions (including emergency calling services),

  • to personalize your experience,

  • to comply with legal requirements and to prevent activities that may violate our policies,

  • to provide customer service,

  • for prevention and detection of fraud and other unauthorized use, and

  • where we have the appropriate permissions to inform you of new products or services that will enhance Ohmic Labs’s ability to provide service to you; however, we will not sell, rent, trade, lease, or disclose or make available any personal data to any third parties seeking to market products to you without your prior consent

How we collect this information

We collect data in a variety of ways, including by use of:

  • cookies, 

  • order forms, and

  • account registrations

How we make information accessible to third parties

We will not disclose or share the personal information outside of Ohmic Labs except in limited circumstances, such as:

  • in order to support the uses mentioned above,

  • for processing orders and credit card transactions, delivering Solutions, hosting websites, support and marketing options, website and Solutions analytics, and assisting with sales-related efforts or post-sales support,

  • in response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by any applicable law, regulation or legal process,

  • to protect the rights, property, or safety of Ohmic Labs, its business partners, you, or others,

  • in connection with, or during negotiations of, any merger, reorganization, restructuring, consolidation, acquisition, financing, dissolution or sale of all or a portion of the business or financing, dissolution, or acquisition of all or a portion of our business by or to another company, and/or

  • if we otherwise notify you and you consent to the sharing.

When you provide personal information to us, we will not share that information with unaffiliated third parties without your permission, other than in circumstances such as above. We may send out important notices informing you of changes to our policies, technical service issues related to a product or service, or other information that is essential to the use of our Sites or Solutions. You or we may post feedback, or community postings, blog or other information on our Sites which may include your name, industry, company, title, or other identifying information. Any postings that you make, or that we make with your consent, are made at your own risk, and we will not be liable for the posting or the distribution of the information contained or associated with the posting. If you want such postings removed or wish to give or withdraw consent, please contact us by emailing contact@ohmic.io.  We cannot insure the requested removal, but will make reasonable efforts to do so. 

You may encounter links to third-party sites (e.g., business partners) and although a connection may be made to such sites, we are not responsible for their privacy policies and this Privacy Policy does not cover their practices. 

How we collect information from third parties

We may collect the information from third parties to market our Solutions. This collection of information and marketing is always carried out in compliance with applicable law. We only collect this information where we have verified that these third parties either have your consent or these third parties are otherwise legally permitted or required to disclose your personal information to us.

 

For our customers and account holders, we may collect personal information about you (such as names, e-mail addresses, postal addresses and city of residence) from other sources, including publicly available databases or third parties from whom we have purchased data, and combine this data with information we already have, in accordance with applicable laws. This helps us to update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you. We do not use collected end user information for marketing without your consent.

 

You may opt out of marketing communications from us by using the “unsubscribe” link within each email or by following the opt-out process described in the SMS communications. 

How we protect your information

We intend to protect the personal information entrusted to us and treat it securely in accordance with this Privacy Policy. Ohmic Labs implements safeguards designed to protect your personal information from unauthorized access, use, or disclosure. We also contractually require that our suppliers protect such information from unauthorized access, use, and disclosure. We make good faith efforts to provide the security measures necessary to keep the integrity and confidentiality of your information safe. However, no system can be completely secure, and we do not ensure, guarantee or warrant that our security measures are impenetrable. The Internet, for example, cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any personal information you provide to us. Also, please be advised that Ohmic Labs has no control over or responsibility for the security or privacy policies or practices of other sites on the Internet you might visit, with which you interact, or from which you might buy products or services, even if you visit them using links from the Sites.

You also have a significant role in protecting your information. As an example, you should not share your password with anyone. If you believe that your password has been compromised, you should immediately change your password. You should also sign off when you’ve finished using a shared computer, and you should always log out of any website, including the Ohmic Labs website, after viewing personal account information, such as the “Preferences” section of our website.

How you can change your information

We make good faith efforts to provide you with access so you can edit or update your personal information. You may have the ability to view or edit some of your personal information online. Profiles created on our Sites may be kept at different locations for different services; you may have to review and update the information in multiple locations. You may review and update this information or request deletions of any and all of your personal information at any time by contacting contact@ohmic.io.

Cookies and other similar technologies

Cookies are small text files placed on your device to store data that can be recalled in compliance with this Privacy Policy. This data uniquely identifies your device, but may also contain other information. Some cookies are placed by third parties acting on our behalf which we describe below under “Third-party cookies”. Our cookies help provide additional functionality to and track traffic patterns on the Sites, combat potential fraud, and study how our users use and interact with the Sites and Solutions. In addition, we may use Cookies to personalize service to you such as providing suggestions, or personalized or customized content. Cookies also help us keep track of your preferences .

  

Strictly Necessary cookies: These cookies are necessary for the Sites to function and cannot be switched off in our systems. They are often set in response to actions taken by you, such as a request for services, setting your privacy preferences, logging in or filling in forms.

 

Functional cookies: These cookies enable the Sites to provide enhanced functionality and personalization. They may be set by us or by third party providers whose services we have added to our pages.

 

Performance cookies: These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our Site. They help us to know which pages are the most and least popular and see how visitors move around the Sites.

Cookie Preferences on Ohmic Labs’s Sites: Our cookies allow you to take advantage of some essential and useful features. Blocking some types of cookies may impact your experience of our Sites. 

 

Browser settings: You can also manage browser cookies through your browser settings. The 'Help' feature on most browsers will tell you how to remove cookies from your devices, prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, how to disable cookies, and when cookies will expire. Check the support site for your browser to understand privacy settings available to you. If you block or reject some of our cookies through your browser’s settings, you might not be able to use certain offerings that require you to sign-in to an account and some features and services may not work. You might also have to manually adjust your preferences or settings every time you visit our Sites. 

We have no direct relationship with the individuals, if any, whose personal data our customers transmit, receive, and/or store through Solutions or the individuals, if any, whom you contact through the Solutions. If you choose to provide Ohmic Labs with a third party's personal information (such as name, email, and phone number), you represent that you have the third party's permission to do so.

If you are an individual who is being contacted by one of our customers through the Solutions and would no longer like to be contacted by such customer through such services, please contact the contacting party directly.

Any individual whose personal data is included in the communications sent, received, and/or stored by one of our customers through a Solution or a Site, who seeks access or who seeks to correct, amend, or delete any such inaccurate data should directly target their request to that customer. The customer is the controller of such data and may provide such access to such data or may perform any correction, amendment, or deletion thereof.

Ohmic Labs is not responsible for any action or inaction by any of its customers or any third party under this Privacy Policy.

Transfer of Your Information Across Borders

Your information may be stored and processed in the United States or any other country in which Ohmic Labs or its partners maintain facilities. By using our Sites, you consent to any transfer, storage, or processing of information outside of your country. You may request us not to transfer your personal information to certain countries, but if you do, we may not be able to provide the Solutions you have requested from us. Several countries, including those in the European Economic Area (EEA), the United Kingdom (UK) and Switzerland have established data protection laws and regulations that place restrictions on the transfer of personal information across country borders. We are committed to complying with all of those laws and regulations. 

Some countries may not have the same or substantially similar privacy laws as those set out in this Privacy Policy. We may not require organizations to which we disclose personal information in those countries to comply with similar privacy laws, and accordingly your personal information may not receive the same protections that it would under the laws where you are located. Where personal information in the EEA, the UK or Switzerland is being transferred to a recipient located in a country that has not been recognized by the relevant authorities as having an adequate level of data protection, Ohmic Labs will transfer personal data in accordance with the Standard Contractual Clauses approved by the relevant authorities.

When you use our Sites and provide personal information, you should do so in compliance with the applicable data protection laws and regulations in your country.

Your Privacy Rights as a data subject protected by EEA/UK law or as a California Resident

If you are a person located in the EEA/UK or if you are a California resident, you may have broader rights to access and delete your personal information, to object to or restrict processing of your personal information, to correct your personal information, or request portability of your personal information.

 

  • Access: You can request more information about the personal data we hold about you. You can request a copy of the personal data.

  • Rectification: If you believe that any personal data, we are holding about you, is incorrect or incomplete, you can request that we correct or supplement the data. You can also correct some of this information directly by logging into your account, if you are a customer. Please contact us as soon as possible if you notice any inaccuracy or incompleteness.

  • Objection: You can let us know that you object to the collection or use of your personal data for certain purposes.

  • Erasure: You can request that we erase some or all of your personal data from our systems. If you are a customer, you can also delete some of this information directly by logging into your account.

  • Restriction of Processing: You can ask us to restrict further processing of your personal data.  This means that you can ask us to stop using it for the purpose we have been using it. This may mean that we have to delete your account.

  • Portability: You can ask for a copy of your personal data in a machine-readable format. You can also request that we transmit the data to someone else where it’s technically possible.

  • Withdrawal of Consent: If you have consented to our use of personal data for a specific purpose, you have the right to change your mind at any time. Any such decision will not affect any processing that has already occurred, nor will it affect processing of your personal information conducted in reliance of lawful processing grounds other than consent. Withdrawing your consent may mean your access to the Solutions will be limited or suspended, and your accounts may be terminated, as applicable. Where you withdraw your consent, but we are using your information because we or a third party (e.g., your employer) have a legitimate interest in doing so, or we have different legal basis for using your information (for example, fulfilling a contract with you), we may continue to process your information, subject to your rights to access and control your information.

  • Right to File Complaint: You have the right to lodge a complaint about our practices with respect to your personal data with the supervisory authority of an EU Member State, or the California Attorney General.

Additional Privacy Rights as a California Resident

If you are a California resident and receive Solutions or visit our Sites solely as a private individual—in other words, not as the member or representative of a company or other organization—you may have the right to receive a free, yearly accounting of:

 

  • information identifying each third-party company to whom we may have disclosed, within the past year, personal information pertaining to you for those third parties’ direct marketing purposes and

  • a description of the categories of personal information disclosed.

You may have the right to know more about personal information that we have collected or disclosed, including:

 

  • the categories of personal information that we have collected or shared about you during the preceding 12 months,

  • the categories of sources from which we have collected that information during the preceding 12 months,

  • the commercial or business reason(s) we have collected or shared that information,

  • the categories of third parties with whom we have shared or to whom we have sold that information during the preceding 12 months, and

  • pursuant to a verifiable request, the specific pieces of information that we have collected about you.

We will not discriminate against you for exercising any of these rights under the CCPA. 

Depending on the nature of your request, we may need additional information to verify your identity.

How long we retain information

We will retain your personal information for no longer than is necessary to fulfill the purposes for which the information was originally collected. However, if a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other legitimate and lawful business purposes, we will retain the information in accordance with such requirements or purposes.

Where we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it.

Children’s Information

The Site is not intended for use by individuals under the age of 16. We do not knowingly collect personal data from nor send requests for personal data to individuals under the age of 16.

How we update this Privacy Policy

Ohmic Labs may update and make changes to this Privacy Policy at any time. When we do so, we will also revise the date at the bottom of this page and at the top of the first page of the Privacy Policy. When we make material changes to the Privacy Policy, we will notify you by placing prominent notice on the Sites.
